Terms of Service

1. Who we are and what these terms cover

These Terms of Service ("Terms") govern your purchase and use of digital products and services offered by Ohneisser LLC ("Ohneis", "we", "us") through ohneis652.com and associated checkout pages, including the Ohneis Visual System course, mini-courses, downloadable resources, community access, certification, and job board access (together, the "Products"). By purchasing or accessing any Product, you agree to these Terms and to our Refund Policy, Privacy Policy and Earnings Disclaimer, which are part of these Terms.

2. Digital products and immediate delivery

All Products are digital. Access is delivered immediately after successful payment via email and/or through our course platform. You acknowledge and agree that delivery is complete when access credentials or access links have been sent to the email address you provided at checkout.

If you are a consumer in the EU, EEA or UK: By purchasing, you expressly request and consent to immediate delivery of the digital content, and you acknowledge that you thereby lose your statutory 14-day right of withdrawal once delivery has begun. In its place, our voluntary guarantee in the Refund Policy applies.

3. Payments and payment plans

Payments are processed by Stripe. Prices are in US dollars and exclude any applicable taxes unless stated otherwise. Where a payment plan is offered (for example 4 × $275), this is an installment plan for a single one-time purchase — it is not a subscription and cannot be cancelled once the digital content has been delivered. You remain responsible for all installments. If an installment payment fails and is not cured within 14 days of our notice, we may suspend your access until the outstanding balance is settled, and the remaining balance stays due.

4. Your license

Upon full payment (or while a payment plan is in good standing), you receive a personal, non-exclusive, non-transferable, non-sublicensable license to access and use the Product content for your own learning and for your own commercial creative work. You may not share, resell, redistribute, publish, or make course content, prompts, templates or downloads available to any third party, including by sharing login credentials. Prompts and templates may be used in your client work; the underlying materials themselves may not be handed to clients or the public. We may revoke access without refund in case of material breach of this section.

5. Community, certification and job board

Community access (including on Skool) is subject to respectful conduct. We may remove members who harass others, spam, share pirated content or solicit our members, without refund. The Ohneis certification is awarded on completion of the stated requirements; it is a private credential and no guarantee of employment or income. The job board (operated at thepromptists.com) lists third-party opportunities; we are not a party to, and do not guarantee, any engagement between you and a listing party.

6. Results and earnings disclaimer

We show real examples, including our own brand deals and student outcomes. These are not a promise of your results. Your outcomes depend on your effort, skill, market and factors outside our control. See the Earnings Disclaimer for details. Nothing in the Products is legal, tax or financial advice.

7. Updates, tools and availability

The Products teach fast-moving AI tools. We update content on the schedule stated on the applicable sales page. Third-party tools referenced in the Products (e.g. image or video models) are not ours; their pricing, features or availability may change at any time, and such changes are not a defect of the Product. We may substitute equivalent tools in the curriculum. Planned maintenance or short interruptions of the course platform do not entitle you to a refund.

8. Refunds, disputes and chargebacks

Refunds are governed exclusively by our Refund Policy. Before initiating any payment dispute or chargeback, you agree to contact us at ohneis@ohneis652.com and allow us 14 days to resolve the issue. We respond to payment disputes with our records, including your acceptance of these Terms at checkout (with timestamp and IP address), delivery logs and platform activity logs. If a chargeback is resolved in our favor or is found to be unfounded, we may permanently revoke access to all Products.

9. Intellectual property

All course content, prompts, templates, PDFs, videos, branding and the "Ohneis652" name remain the property of Ohneisser LLC or its licensors. Outputs you create with AI tools using skills learned in the Products are yours, subject to the terms of the respective AI tool providers.

10. Limitation of liability

To the maximum extent permitted by law, our total liability arising out of or related to a Product is limited to the amount you paid for that Product in the 12 months before the claim arose. We are not liable for indirect or consequential damages, lost profits, or losses caused by third-party tools or platforms. Nothing in these Terms limits liability that cannot be limited by law, including (for EU/UK consumers) liability for intent, gross negligence, or injury to life, body or health, and your mandatory consumer rights remain unaffected.

11. Changes to these terms

We may update these Terms for future purchases. The version you accept at checkout governs your purchase. We archive each version with its effective date.

12. Governing law

These Terms are governed by the laws of the State of Wyoming, USA. If you are a consumer in the EU, EEA or UK, you additionally retain the protection of the mandatory consumer-law provisions of your country of residence, and you may bring proceedings in your local courts where the law so provides.
